Our attorneys, along with a team from Alabama-based law firm Beasley Allen, successfully represented Jean Bookout and the family of Barbara Schwarz in a landmark case against Toyota. Our team alleged that the electronic throttle control system (ETCS) on Mrs. Bookout’s 2005 Toyota Camry was defective, causing the vehicle to suddenly accelerate. Led by Senior Partner Paul Martin, the Martin Jean & Jackson legal team fought back against Toyota’s hard stance that sudden acceleration was an imaginary phenomenon and worked to prove that the issue was not with a lack of a brake override system but, rather, a defect in the ETCS itself.
An Oklahoma City jury returned a multimillion-dollar verdict in favor of the plaintiffs, making this a groundbreaking case for several reasons. First, this was the first time a case had been successfully brought against Toyota after three previous failed sudden acceleration trials. Secondly, the verdict resulted in Toyota entering settlement talks in almost 400 pending lawsuits throughout the United States.
Additionally, the jury found that Toyota had acted with “reckless disregard” for the rights and safety of the plaintiffs, resulting in a decision that punitive damages were warranted. Toyota ultimately settled for a confidential amount prior to proceeding to the punitive damages state of the trial.
